1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and StaycationKE ("we", "us" or "our") governing your access to and use of the website located at www.staycation.ke (the "Site") and all associated services.

By accessing the Site, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are accessing the Site on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

2. Our Services

StaycationKE is a travel discovery and booking facilitation platform. We curate and present information about hotels, villas, lodges and cottages in Kenya and Zanzibar. Our services include:

Displaying property listings with descriptions, photos and pricing information

Facilitating bookings through our Expedia affiliate partnership

Processing direct booking enquiries via our booking request form

Providing travel information and destination guides

We act as an intermediary and marketing affiliate. We are not a party to any booking contract between you and a property owner or operator, except where we facilitate direct bookings through our request form.

3. Permitted Use

You may use the Site for lawful purposes only. You agree not to:

Use the Site in any way that violates applicable laws or regulations in Kenya, Tanzania (for Zanzibar) or your jurisdiction

Reproduce, duplicate, copy, sell or exploit any portion of the Site without our express written permission

Transmit unsolicited commercial communications through the Site

Attempt to gain unauthorised access to any part of the Site or its related systems

Use automated scraping tools, bots or crawlers to extract data from the Site

Submit false, misleading or fraudulent booking requests

Impersonate any person or entity or misrepresent your affiliation with any person or entity

4. Bookings and Reservations

Expedia Bookings

When you click through to book a property via Expedia, you leave our Site and enter Expedia's platform. Your booking is governed entirely by Expedia's Terms of Service, cancellation policies and payment terms. StaycationKE is not responsible for any aspect of bookings made through Expedia, including pricing accuracy, availability, cancellations or disputes.

Direct Booking Requests

For properties where you submit a direct booking request through our form, we will endeavour to confirm availability within 24 hours. A booking is not confirmed until you receive written confirmation from us. We reserve the right to decline any booking request at our discretion. Cancellation terms for direct bookings will be specified in your booking confirmation.

Pricing

Prices displayed on the Site are indicative and in Kenyan Shillings (KES) per night. Prices are subject to change without notice. Actual booking prices, including applicable taxes and fees, will be confirmed at the time of booking through Expedia or in your direct booking confirmation.

5. Affiliate Relationships

StaycationKE participates in the Expedia affiliate programme. This means we earn a commission when you make a qualifying booking through links on our Site. This commission is paid by Expedia and does not affect the price you pay. Our affiliate relationship does not influence which properties we feature — all listings are selected based on quality and relevance to our users.

6. Intellectual Property

The Site and its original content, features and functionality — including but not limited to text, graphics, logos, images and software — are owned by StaycationKE and are protected by applicable intellectual property laws.

Property photographs displayed on the Site are either licensed from stock photography providers (including Unsplash) or provided by property operators. You may not reproduce, distribute or use these images without appropriate authorisation.

The StaycationKE name, logo and brand identity are proprietary. You may not use them without our prior written consent.

7. Disclaimers

The Site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

The Site will be uninterrupted, error-free or free of viruses

Property information, pricing and availability displayed on the Site is accurate, complete or current

The quality of any property, service or information obtained through the Site will meet your expectations

Property descriptions, photos and ratings are provided for informational purposes only. We strongly recommend conducting your own research and reading all property policies before making a booking.

8. Limitation of Liability

To the fullest extent permitted by applicable law, StaycationKE shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, goodwill or other intangible losses, arising from:

Your access to or use of (or inability to access or use) the Site

Any booking made through or facilitated by the Site

Any property experience, including cancellations, quality issues or disputes

Unauthorised access to or alteration of your transmissions or data

Our total liability to you for any claim arising out of or relating to these Terms or the Site shall not exceed KES 10,000 or the amount you paid to us in the 12 months preceding the claim, whichever is less.

9. Indemnification

You agree to defend, indemnify and hold harmless StaycationKE, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Site, your breach of these Terms, or your violation of any third-party rights.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
